In Macrix Technology Group, we process your personal data under the Contract of joint controlling of personal data, concluded between the following Joint Controllers: Macrix Polska Sp. z o.o. with its registered office in Poznań (60-324), Poland, Marcelińska 90 (entered into National Court Register under the number: 0000003410); Macrix Polska sp. z o.o. sp. k. with its registered office in Poznań (60-324), Poland, Marcelińska 90 (entered into National Court Register under the umber: 0000352143); Macrix Polska sp. z o.o. World Services sp. k. with its registered office in Poznań (60-324), Poland, Marcelińska 90 (entered into National Court Register under the number: 0000353747) and Macrix Software GmbH with its registered office in Mönchengladbach, Am Nordpark 1, Germany (entered into the register of companies under number: HRB 18522) - hereinafter collectively referred to as Joint Controllers. Each of the Joint Controllers process personal data within the scope of their obligations stemming from the legal relationship between you and Macrix. Furthermore, we inform you that your personal data may be transferred to our partners: BSS Bohnenberg GmbH, located at Ahrstraße 1 - 7, 42697 Solingen, Germany (VAT ID No.: DE 120962049, HRB Wuppertal 15581, Court of Jurisdiction Wuppertal), and CRON Systems-Automation GmbH, located at Langenberger Str. 505, 45277 Essen, Germany (Essen District Court HRB 10301), to the extent necessary for carrying out the recruitment process and further cooperation. The legal basis of processing your personal data is to take an action at your request before the possible conclusion of a contract, i.e. to consider your recruitment application (under the Article 6 (1) (b) GDPR). We also process your personal data to fulfill the legal obligations of the Joint Controllers related to recruitment process and possible, subsequent conclusion and enforcement of a contract (under the Article 6 (1) (c) GDPR). For instance, we process personal data, which is necessary to provide in order to participate in recruitment process and conclude an employment contract based on polish labor law. The processing is also necessary for compliance with a legal obligation to which the Joint Controller is subject in the course of the employment relationship. This means that the provision of personal data referred to in Article 22 (1) of the polish Labor Code is necessary to take part in recruitment process and to conclude a contract of employment, and then to meet the legal obligations imposed on the Joint Controllers (e.g., to pay social security contributions for the hired person), and therefore failure to provide the required information justifies the employer's withdrawal from employment negotiations. We will use your personal data for the purpose of future recruitment processes and for other ongoing recruitments and for other ongoing recruitments only if you have given us your separate consent (under the Article 6 (1) (a) of the GDPR). We process personal data other than officially required by polish Labour Code (e.g. image) only on the basis of your voluntary consent, which you have given us by sending us your recruitment application (under the Article 6 (1) (a) of the GDPR as well). Provision of such data does not affect your ability to participate in the recruitment. Withdrawal of a consent to the processing of personal data will only be possible if there is no other purpose and legal basis justifying processing your personal data by us. For example, after the recruitment process is finished, we may also process your personal data included in the recruitment application based on our legitimate interest to establish, exercise or defense of legal claims related to the recruitment (under the Article 6 (1) (f) GDPR). You can withdraw your consent to process data for future recruitment processes and for other ongoing recruitments at any time by contacting us at hr@macrix.pl . However, in any case, your personal data will be retained for no longer than time of limitation, i.e. for a maximum period of 3 years after the end of the recruitment process. We also inform you that you have the right of access by the data subject, including obtaining a copy of the data, the right to rectification, the right to erasure (i.e. so called, the right to be forgotten), right to restriction of processing, the right to data portability, the right to object the processing. You also have the right to lodge a complaint with an appropriate supervisory authority (President of the Personal Data Protection Office in Poland or German Federal Commissioner for Data Protection and Freedom of Information). The withdrawal of the consent for processing does not affect the lawfulness of processing based on consent before its withdrawal. We may transfer your personal data to providers of job advertisement publication services, providers of recruitment management systems, providers of IT services such as hosting, and providers of IT systems. Macrix Technology Group does not transfer your personal data outside the European Economic Area. All data centers used both by us and by our suppliers are located in Europe. Our suppliers declare that, in the event that it is necessary to transfer personal data outside the EEA, they will apply appropriate safeguards with regard to such transfer, e.g. standard contractual clauses. In the event when the parent company of our supplier is based in the USA, the transfer of personal data will take place under the "EU-US Data Protection Framework" on the basis of the European Commission's decision as of 10 July 2023 stating an adequate level of data protection ensured by the US companies participating in the program. The abovementioned decision of the European Commission provides a number of safeguards measures, relating to the powers of security authorities exercised under the so-called CLOUD Act (according to the adopted decision the authorities will be able to obtain an access only if such action is necessary and proportionate to protect national security). You can always receive a copy of the relevant safeguards measures by contacting us via the contact addresses provided in the present clause. Your personal data will not be processed by us in any automated manner, nor will it be profiled under the meaning of the Article 22 (1) and (4) of the GDPR.
